1. Introduction

These Terms of Application and Privacy Notice ("Terms") govern your submission of an application to Mokoni Model Management ("Mokoni", "we", "us", "our") through this website. By submitting an application, you confirm that you have read, understood and accepted these Terms. If you are under 18, your parent or legal guardian must also read and accept these Terms on your behalf.

Mokoni is a mother agency. We scout, develop, place and manage models. We are not a modelling school and we do not guarantee employment, casting, placement or income.

2. Who We Are (Data Controller)

Mokoni Model Management is the data controller responsible for the personal information you submit. You can reach us at info@mokonimodelmanagement.com for any question about this notice or your data.

3. Information We Collect

When you submit an application we collect:

• Identity data: full legal name, preferred name, date of birth, age, sex, gender identity, nationality, place of birth.
• Contact data: phone number, WhatsApp number, email address, social media handles, current residence.
• Guardian data (if under 18): parent or guardian name, relationship, email and phone.
• Physical data: height, weight, measurements, dress and shoe size, hair and eye colour, skin tone, tattoos, piercings, scars, distinctive features.
• Professional data: modelling experience, agencies, campaigns, runway shows, training, portfolio links, availability, representation status.
• Media: photographs, introduction video, and any portfolio or comp card you upload.
• Emergency contact data: name, relationship and phone number.
• Technical data: IP address, browser type, device information and pages visited, collected automatically for security and analytics.

4. How We Use Your Information

We use your information to:

• Assess your application and determine whether to offer representation.
• Contact you about your application and about potential opportunities.
• Build and maintain a digital profile or comp card for internal review.
• Submit your profile to international partner agencies, casting directors, photographers and brands — only where you have consented or where it is necessary to progress your career.
• Comply with legal obligations and resolve disputes.
• Improve our scouting process and website.

5. Legal Basis for Processing

We process your data on the basis of: (a) your consent, given when you tick the consent boxes in this form; (b) the performance of a contract or steps towards a contract if you are offered representation; (c) our legitimate interests in scouting and developing new talent; and (d) legal obligation where applicable. Where you are under 18, we rely on the consent of your parent or legal guardian.

6. Photography, Video and Likeness

By uploading photographs and video you confirm that: (i) you own the content or have permission from the photographer or rights holder to share it; (ii) the images are of you and are recent; and (iii) you grant Mokoni a non-exclusive, worldwide, royalty-free licence to store, review, edit (for comp card and portfolio purposes) and share your images and video with partner agencies, casting directors and clients strictly for the purpose of evaluating and progressing your modelling career. This licence ends when you withdraw consent, except where we are required to retain the data for legal reasons or where a third party already holds a copy as part of a completed casting or placement.

7. Sharing and Disclosure

We share your data only with:

• International partner agencies and mother agencies for placement consideration.
• Casting directors, photographers, brands and clients considering you for work.
• Service providers who host our website, send our email or store our files, under confidentiality obligations.
• Law enforcement or regulators where we are legally required to do so.

We do not sell your personal data.

8. International Transfers

Because modelling is an international industry, your data may be transferred to and processed in countries outside your own, including countries that may not provide the same level of data protection. Where we do this, we take reasonable steps to ensure your data is protected, including using contractual safeguards with our partners.

9. Data Retention

We keep application data for up to 24 months from the date of submission if you are not signed, so we can reconsider you for future opportunities. If you are signed, we retain your data for the duration of your representation and for a reasonable period afterwards to comply with legal and accounting obligations. Uploaded media is stored only as long as necessary for the purposes above. You may request deletion at any time (see Section 10).

10. Your Rights

Depending on where you live, you may have the right to:

• Access a copy of the personal data we hold about you.
• Correct inaccurate or incomplete data.
• Request deletion of your data ("right to be forgotten").
• Restrict or object to certain processing.
• Withdraw consent at any time, without affecting the lawfulness of processing already carried out.
• Receive your data in a portable format.
• Lodge a complaint with your local data protection authority.

To exercise any of these rights, email info@mokonimodelmanagement.com with the subject "Data Request". We will respond within 30 days.

11. Minors and Guardian Consent

Applicants under 18 must have a parent or legal guardian complete the guardian section of this form and accept these Terms on their behalf. We will copy the guardian on all substantive correspondence, and we will not place a minor on an international assignment without written guardian consent and appropriate safeguarding arrangements. We comply with applicable child protection and child labour laws.

12. Security

We use appropriate technical and organisational measures to protect your data, including encrypted transmission (HTTPS), access controls and secure storage. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security, but we take our obligations seriously and will notify you and the relevant regulator of any breach that affects your rights.

13. Cookies and Analytics

Our website may use cookies and similar technologies to keep the application form working, remember your progress and understand how the site is used. You can disable cookies in your browser, but parts of the application may not work correctly. We do not use cookies for advertising.

14. Scouting and Representation Disclaimer

Submitting an application does not create an agency agreement, an employment relationship or any obligation on Mokoni to represent you. Representation only arises if we send you a written agency agreement and you countersign it. We do not guarantee any casting, booking, placement or income. Any decision to accept or decline an application is at our sole discretion.

15. Fees and Payments

Applying to Mokoni is free. We never ask for payment to submit an application, to be considered, or to be "registered". If we ever recommend paid services (for example professional test shoots or training), these are optional, invoiced transparently, and never a condition of representation. If anyone claiming to represent Mokoni asks you for money to apply, please report it to info@mokonimodelmanagement.com immediately.

16. Third-Party Platforms

Our website links to third-party platforms such as Instagram, TikTok, Facebook and WhatsApp. Their privacy practices are governed by their own policies, which we do not control. We encourage you to review them.

17. Changes to These Terms

We may update these Terms from time to time. The version in force is the one published on this page at the time you submit your application. Material changes will be notified to signed models by email.
